Contract to Buy and Sell Real Estate (Co_Contract_to_Buy_&_Sell_RealEstate.docx): This is the Word version of the sales contract approved by the Colorado Real Estate Commission. Starting with the table on the first page, this document looks more complicated than it really is. The “Reference” numbers in the table refer to paragraphs in the contract and the table is simply a checklist of the things that must happen between signing the contract and completing the sale. If you have a low tolerance for technical writing we suggest reading no more than 3 pages at a sitting.
- Designed by the state of Colorado to handle almost all real estate sales, this 15 page document might be overkill for some homeowners, so we included what we call Simple "Sales_Contract” (Co_Simple_Sales_Contract_form.docx), a 4 page document that has been used to sell homes in Colorado and many other states.
- At a minimum the Simple "Sales_Contract” is an easy way for Buyer and Seller to come to legal agreement on price and key terms of the sale. Information from the Simple “Sales_Contract” can be transferred to the official Contract to Buy and Sell Real Estate form by the officer who handles the “Closing.” We also included a sample filled out 1st page of the Simple Sales Contract.
Closing Instructions and Earnest Money (Co_InstructionsReceipt_wd2007.docx): Buyer and Seller who have agreed to price and basic terms (and perhaps signed a Simple Sales Contract) engage the services of a Colorado closing company to provide closing and settlement services, such as holding cash deposits, collecting cash from mortgage lender, paying taxes and providing a certified check for net proceeds to Seller. The closing company is a prime candidate to transfer information from the Simple Sales Contract to the official Colorado Contract to Buy and Sell Real Estate
Seller’s Property Disclosure Statement (Co_Sellers_Property_Disclosure.docx ): Answer a series of questions about the property with “Yes”, “No” and “Don’t know.” Make several copies, and attach a copy to each Sales Contract or Offer to Purchase Agreement. “Don’t know” is a perfectly acceptable answer.
Lead Paint Disclosure (Co_Lead_Paint_Disclosure_form_wd2007): If the home was built in 1978 or later, indicate that and attach the basically blank form to the Sales Contract. If the home was built prior to 1978, answer the questions and print several copies for attachment to Sales Contracts.
Counter Proposal (Co_Counter_proposal_2011.docx): This is essentially a blank form that provides a medium for either the Seller or Buyer to describe terms they would like made to the currently offered Purchase and Sale Agreement. For simple changes like the purchase price amount the Seller or Buyer can simply draw a line through the offered amount and write an acceptable price directly onto the Purchase and Sale Agreement. The Counter Offer provides a more formal method of making complex changes.
Simple Sales Contract form: (Co_Simple_Sales_Contract_form.docx): This is a 4 page version of the 15 page official Colorado Contract to Buy and Sell Real Estate which will meet the needs of most home owners selling a single home..
Sample Simple Sales Contract (Co_Sample_Simple_Sales_Contract_1stP_wd2007): This is the filled out first page of a Simple sales contract. In most cases the first page requires more information from the Seller than the rest of the pages combined. Much of it requires input from a potential Buyer willing to say how much cash he or she will provide for a down payment and the size and type of mortgage loan he or she will seek.
Square Footage Disclosure (Co_Square_FootDisclosure_wd2007.docx): This form provides a place to record the size of the property in square feet, as measures by licensed Realtors and other sources such an appraiser, local taxing authorities, or the building plans
Forms for estimating net cash to Seller, and a Buyer’s ability to afford the asking price.
Net to Seller (Net_to_Seller_ws2007.docx): This form allows user to enter estimates of all closing costs (balance on current mortgage loan, attorney’s fee, Title search, etc). The user manually subtracts the total estimated cost from the Purchase Price to get the amount of cash the Seller will receive at closing.
Buyer Pre-Qualification (Buyer_Pre_Qualification_wd2007.docx):: This form records the prospective Buyer’s annual income and expenses and provides manual calculation formula to determine if Buyer can afford the asking price.
Buyer Pre-Qual Sample (Buyer_Pre_Qual_Sample.docx): Buyer Pre-Qualification form filled out for a Buyer with $48,000 annual income. Based on the sample Buyer’s monthly expenses, the form estimates that Buyer can afford a $144,000 house.
